Fear of Flying Course – Terms & Conditions

These Terms and Conditions apply to bookings for our Fear of Flying One-on-One Session and any related course, briefing, simulator session, or associated service we provide.

By booking, purchasing, attending, or participating in this course, you agree to these Terms and Conditions.

1. About the Course

The Fear of Flying course is a private One-on-One Session delivered by our experienced instructor. The session is conducted exclusively between the participant and the instructor. No other participants will attend.

The course is generally conducted over approximately 4 to 5 hours and may include:

  • One-on-One discussion and briefing room instruction;
  • education about flying, airline operations, and normal flight procedures;
  • the opportunity to ask questions about commercial flying;
  • One-on-One time in our Boeing 737 simulator; and
  • practical simulator-based familiarisation activities.

The exact structure, sequence, timing, instructor, and content of the course may vary between participants and sessions.

2. Nature of the Service

The course is delivered by our experienced instructor. In the event our experienced instructor is unavailable, we may be required to suspend, reschedule, or cancel the course. Where this occurs, affected customers will be contacted and an appropriate remedy provided in accordance with the Australian Consumer Law.

This course is an educational and simulator-based familiarity service only.

It is not:

  • medical treatment;
  • psychological treatment;
  • psychiatric treatment;
  • counselling;
  • a crisis service; or
  • a guarantee that a participant will overcome fear or anxiety about flying.

We do not represent that participation will produce any particular emotional, medical, therapeutic, or personal outcome. Any statements on our website or in marketing material are general in nature and do not amount to a guarantee of results.

3. Participant Suitability

This course is intended for people aged 11 years and over who wish to better understand flying and, where suitable, experience a simulated airline environment in a controlled setting.

By booking or attending, the participant confirms that, to the best of their knowledge:

  • they are fit to attend and participate;
  • they will tell us before the session about anything that may affect safe participation;
  • they understand the course may discuss aviation procedures, incidents, turbulence, aircraft systems, flight operations, and related subjects that some people may find distressing; and
  • they understand the simulator environment may feel intense or emotionally uncomfortable for some participants.

If a participant has a medical condition, mental health condition, severe anxiety condition, panic disorder, epilepsy, vertigo, motion sensitivity, or any other condition that may affect participation, they should obtain appropriate professional advice before booking or attending.

4. No Clinical or Medical Advice

Nothing in this course, our materials, our website, or our communications is medical, psychological, or psychiatric advice.

Participants should seek advice from a qualified health professional where appropriate.

If a participant is under the care of a doctor, psychologist, psychiatrist, or other clinician for anxiety, panic, trauma, or any related condition, we recommend that they consult that practitioner before booking.

5. Bookings and Payment

On making a booking request, a tax invoice will be issued immediately. Payment is due upon receipt of invoice.

A booking is confirmed only once FlightX has issued a written booking confirmation following receipt of payment. Where FlightX is unable to confirm a booking, a full refund will be processed promptly. Refunds are generally received within 14 days, depending on the customer's payment provider.

Prices are in Australian dollars and include GST where applicable.

6. Session Length and Timing

The course is usually scheduled as a single session of approximately 4 to 5 hours.

Session start times are approximate. We may adjust commencement time, instructor allocation, room allocation, simulator allocation, or session flow where reasonably necessary for operational, staffing, safety, maintenance, or other business reasons.

7. Participant Responsibilities

Participants must:

  • arrive on time;
  • follow all lawful and reasonable directions from our staff;
  • behave respectfully toward staff and others on site;
  • not attend under the influence of alcohol or drugs;
  • not interfere with equipment, controls, or safety procedures except as directed;
  • immediately tell staff if they feel distressed, unwell, unsafe, or unable to continue.

We may also pause, modify, or discontinue any part of the session where a participant appears unable to continue safely or where continuing may adversely affect the participant's wellbeing, staff, premises, or equipment.

8. Refusal of Participation or Removal

We may refuse participation, remove a participant, or stop a session where we reasonably believe:

  • participation is unsafe;
  • the participant is intoxicated or affected by drugs;
  • the participant is aggressive, abusive, or disruptive;
  • the participant refuses to follow reasonable directions;
  • continuing the session may risk harm to the participant, staff, premises, or equipment.

Where this occurs, any refund or reschedule will be at our discretion except to the extent the participant has rights under the Australian Consumer Law that cannot be excluded.

9. Cancellations by the Participant

If a participant cancels:

  • more than 7 days before the booked session, FlightX will provide a full refund;
  • between 72 hours and 7 days before the session, FlightX may permit rescheduling or issue a refund less an administration fee of up to $100;
  • within 72 hours of the session, or in the event of non-attendance, the booking is forfeited, the full booking value is lost, and no refund will be provided.

Nothing in this clause limits any rights the participant may have under the Australian Consumer Law.

10. Rescheduling by the Participant

We will try to accommodate reasonable rescheduling requests, but rescheduling is subject to availability.

Rescheduling requests made within 72 hours of the scheduled session will not be accepted.

We may impose reasonable notice requirements and rebooking conditions where permitted by law.

Two or more rescheduling requests, or failure to attend a rescheduled session, may result in forfeiture of the booking value, subject always to applicable consumer rights.

11. Cancellations or Changes by Us

We may reschedule, postpone, substitute instructors, vary the program, or cancel a session where reasonably necessary, including due to:

  • staff illness or unavailability;
  • simulator maintenance or technical issues;
  • safety concerns;
  • operational issues;
  • force majeure events; or
  • other circumstances outside our reasonable control.

Where we cancel and cannot provide the service within a reasonable time or in a suitable alternative form, we will provide an appropriate remedy in accordance with the Australian Consumer Law, which may include resupply, rescheduling, credit, or refund depending on the circumstances.

12. Late Arrival and Shortened Sessions

If a participant arrives late, we may shorten the session so that it still finishes at the scheduled time.

If lateness materially affects our ability to deliver the course, we may treat the booking as a late cancellation or require rescheduling.

13. Simulator and Practical Activities

The course is delivered flexibly and in response to each participant's individual needs and requests. Our instructor will tailor the session accordingly and will not expose participants to content, scenarios, or simulator activities that, in the instructor's professional judgement, may be unduly distressing or counterproductive for that individual.

Use of the simulator remains subject to staff direction at all times.

Participants acknowledge that simulator-based activities may involve aircraft sounds and alert tones, visual sensory input, and discussion of aviation scenarios and procedures.

The simulator is not a real aircraft and does not constitute flight training, licensing, or aviation medical assessment.

14. No Guarantee of Outcome

We do not guarantee that the participant will:

  • eliminate fear of flying;
  • feel comfortable flying after the session;
  • board a future aircraft;
  • avoid anxiety in future travel; or
  • achieve any particular emotional or behavioural outcome.

Any improvement varies between individuals.

15. Photography and Recording

Participants are welcome to take personal photos and videos during the session on their own devices for personal use.

All course content, materials, handouts, diagrams, explanations, and instructional content remain the intellectual property of FlightX. Participants must not reproduce, publish, or commercially use our materials without our prior written consent.

FlightX reserves the right to restrict photography or recording in specific areas of the premises for operational or safety reasons.

16. Privacy

We may collect personal information reasonably necessary to administer the booking, communicate with the participant, and deliver the service.

Where a participant discloses health or wellbeing information to us, they consent to our staff using that information only as reasonably necessary for booking administration, safety, and delivery of the course, in accordance with our Privacy Policy.

17. Liability and Consumer Rights

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other law where it cannot lawfully be excluded or modified.

To the maximum extent permitted by law:

  • we are not liable for indirect or consequential loss;
  • we are not liable for distress, disappointment, or subjective dissatisfaction where the service was delivered with due care and skill and substantially as described; and
  • our liability for breach of any guarantee or obligation that may lawfully be limited is limited to supplying the services again or paying the cost of having the services supplied again.

18. Personal Property

Participants are responsible for their own personal property while on our premises, including during movement between the briefing room and simulator areas. FlightX is not responsible for personal items left unattended in any area of the premises during the session, to the maximum extent permitted by law.

19. Minors

Participants under the age of 18 must be a minimum of 11 years of age. A parent or legal guardian must make the booking and accept these Terms and Conditions on the participant's behalf. For participants under 18 years of age, a parent or legal guardian must remain on the premises for the full duration of the session. Where required by law, or where FlightX otherwise determines it appropriate for child-safety reasons, sessions involving minors will be delivered only by staff who hold a current Working with Children Check.

20. Governing Law

These Terms and Conditions are governed by the laws of Western Australia.

21. Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms and Conditions, the parties agree to the following process:

  1. A party claiming a dispute must notify the other party in writing, setting out the nature of the dispute and a proposed resolution.
  2. The parties will attempt to resolve the dispute by good faith negotiation within 10 days of the notice being received.
  3. If the dispute is not resolved within that period, either party may refer the matter to mediation administered by the Small Business Development Corporation (SBDC) of Western Australia, with the cost of mediation shared equally between the parties.
  4. If mediation is unsuccessful or either party declines to participate, either party may commence legal proceedings in the courts of Western Australia.

Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court where necessary.
