1. Introduction
These Terms of Service (“Terms”) govern your use of the FlightX website and the purchase of products, gift vouchers and simulator experiences from FlightX.
FlightX is operated by FlightX Pty Ltd ABN 20 657 523 058, located at Ground Floor, 355 Newcastle Street, Northbridge WA 6003 (“FlightX”, “we”, “us”, “our”).
By purchasing from us or using our website, you agree to these Terms. These Terms apply to all purchases made in person at our shopfront and through our online store.
Our Privacy Policy, available at https://flightx.com.au/policies/privacy-policy, forms part of these Terms and explains how we collect, use and store your personal information.
For the purposes of these Terms, “Experiences” include all simulator-based and guided activities offered by FlightX, including but not limited to: Boeing 737 simulator sessions, Frequent Flyer packages, group event bookings, Junior Jets sessions, and virtual reality (VR) experiences including VR dogfighting.
2. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law (ACL) or other applicable legislation.
Where a product or service has a major failure under the ACL, you are entitled to a remedy as provided by law.
3. Pricing & Payments
All prices are in Australian Dollars (AUD) and include GST where applicable. We reserve the right to correct pricing errors. Payment must be made in full at the time of purchase.
4. Retail Products (Physical Goods)
4.1 Shipping & Risk
Risk in goods passes to you once the goods are delivered to the delivery address provided at checkout. Shipping, delivery timeframes, click & collect and lost parcel procedures are governed by our Shipping & Returns Policy, available at our website.
4.2 Returns
Returns for change of mind are subject to our Shipping & Returns Policy. Products must be unused, in original packaging, in saleable condition and accompanied by proof of purchase. Return shipping costs are the responsibility of the customer. We reserve the right to apply a restocking or administration fee of up to 20% on change-of-mind returns. This does not affect your rights under Australian Consumer Law.
5. Gift Vouchers
Gift vouchers are valid only at FlightX. Standard vouchers are valid for 36 months from the date of purchase unless otherwise stated. Promotional vouchers may have shorter expiry periods. Vouchers cannot be redeemed for cash but may be upgraded by paying the price difference.
6. Simulator Bookings
6.1 Booking Changes
Bookings may be rescheduled up to 48 hours prior to the scheduled session at no charge.
6.2 Late Changes
Changes requested within 48 hours of the scheduled session may incur a rebooking fee of up to $50.
6.3 No-Shows
Failure to attend without at least 48 hours’ notice will result in forfeiture of the booking and any associated voucher or payment.
6.4 Late Arrival
Late arrival may reduce your simulator time. No compensation will be provided for time lost due to late arrival.
6.5 FlightX-Initiated Cancellations or Rescheduling
In the event that FlightX needs to cancel or reschedule your booking (for example, due to staff unavailability, maintenance or other operational reasons), we will contact you directly by phone or email to arrange a mutually suitable alternative date and time based on our availability.
If no suitable alternative can be agreed, you will be offered a full credit or refund of the amount paid for that booking. This clause does not limit your rights under Australian Consumer Law.
7. Refunds
7.1 Change of Mind – Simulator Experiences
Change-of-mind refund requests for simulator experiences made within 7 days of purchase may incur an administration fee of up to 20%. No change-of-mind refunds will be granted after 7 days from the date of purchase. This applies regardless of whether a booking date has been selected.
7.2 Change of Mind – Retail Products
Change-of-mind returns on retail products are governed by our Shipping & Returns Policy, including the applicable administration fee of up to 20%.
7.3 ACL Rights
Neither refund policy limits your rights under Australian Consumer Law.
8. Safety & Entry Conditions
We reserve the right to refuse participation in a simulator experience if you:
- Appear to be under the influence of drugs or alcohol
- Are physically incapable of safely using the simulator
- Do not meet the minimum age or height requirements set out in Section 11
- Fail to follow instructor directions
- Fail to provide appropriate identification if requested
In such circumstances, a refund will not be provided, except as required under Australian Consumer Law.
Group Bookings and Conduct
For the purposes of these Terms, a “Group” means two or more participants attending under the same booking or attending together for a shared session.
Where a Group booking is made, all participants must comply with these Terms and follow staff directions at all times.
FlightX reserves the right to refuse or terminate participation for any individual whose behaviour is unsafe, disruptive, or impacts the experience of others.
Where a participant is removed for such reasons, no refund will be provided for that participant, except as required under Australian Consumer Law.
9. Technical Issues
If a technical issue reduces or prevents your simulator experience, we will as a minimum offer you a full reschedule or credit. Where rescheduling is not possible, a refund will be provided in accordance with applicable law.
If a pre-purchased photo or flight deck video recording cannot be provided due to a technical issue, our liability is limited to a refund of the recording fee paid.
10. Limitation of Liability
To the extent permitted by law, FlightX excludes all liability for any indirect, incidental, special or consequential loss, including but not limited to loss of business, revenue, profits or opportunity.
Where a consumer guarantee applies under the Australian Consumer Law and cannot be excluded, FlightX’s liability is limited, at its option:
(a) in the case of services, to the resupply of the services or the cost of having the services resupplied; and
(b) in the case of goods, to the replacement of the goods, the supply of equivalent goods, the repair of the goods, or the cost of replacing or repairing the goods.
Subject to the above, FlightX’s total liability to you for any claim arising out of or in connection with these Terms shall not exceed the total amount paid by you for the specific product or experience giving rise to the claim.
This clause does not exclude, restrict or modify any rights you may have under the Australian Consumer Law.
11. Participation Requirements & Assumption of Risk
11.1 Entry Requirements
Participation in a FlightX simulator experience requires all of the following:
- Minimum age of 10 years
- Minimum height of 140 cm
- Ability to enter and exit cockpit seating unaided
- Ability to tolerate large-screen visual projection (which may cause mild disorientation or discomfort in visually sensitive individuals)
- Ability to follow instructor directions throughout the session
It is your responsibility to confirm your suitability, and the suitability of any participant on whose behalf you are booking, prior to making a booking. No refund will be provided where a participant is refused entry or cannot complete the experience because they do not meet these requirements, unless otherwise required by law.
11.2 Minors
Participants under the age of 18 must be accompanied by a parent or legal guardian who is present at the venue for the duration of the session. By booking on behalf of a minor, the parent or guardian accepts these Terms on the minor’s behalf and acknowledges the assumption of risk described in Section 11.3.
11.3 Assumption of Risk
Our simulator is a fixed-base flight simulator with large-screen visual projection. Participation is voluntary and inherently involves some degree of physical and sensory engagement. By booking and participating, you acknowledge and accept that the experience may involve simulated flight manoeuvres and visual effects that could cause discomfort, and you assume responsibility for any risk inherent in the activity that is not caused by our negligence or breach of statutory duty.
12. Photography & Video Recording
FlightX does not photograph or film participants during simulator sessions unless a photo package or flight deck video recording has been purchased as an add-on at the time of booking or on the day.
Where a recording package has been purchased, the footage is provided for the personal use of the customer only. FlightX does not retain the right to use your footage for marketing or promotional purposes without your separate express consent.
13. Website Use
All content on this website, including text, images, branding and simulator materials, is the property of FlightX and may not be reproduced without permission. We reserve the right to suspend or restrict website access if misuse is detected.
14. Governing Law
These Terms are governed by the laws of Western Australia, Australia. Any disputes shall be subject to the jurisdiction of the courts of Western Australia.

16. Force Majeure
FlightX will not be liable for any delay or failure to perform its obligations where such delay or failure is due to events beyond its reasonable control, including but not limited to power outages, external equipment or infrastructure failure, building access issues, natural events, flood, fire, cyclone, pandemic, epidemic, public health emergency, or government restrictions.
This clause does not apply to routine equipment malfunction or maintenance issues, which are addressed under Section 9 (Technical Issues).
Where such an event occurs, FlightX will make reasonable efforts to reschedule affected bookings or provide a suitable alternative remedy in accordance with the Australian Consumer Law.
